Flight Delay Compensation: When You May Be Eligible
A long delay can trigger more than an apology. Your route, operating airline, arrival delay and the reason for the disruption all help determine whether compensation rules apply.
What to know
- For EU261 and UK261 claims, the delay at your final destination is usually the key measurement.
- A delay of three hours or more may qualify when the disruption was within the airline’s control.
- Care such as meals or a hotel is separate from cash compensation and may be due even when compensation is not.
Start with the route and operating airline
EU passenger-rights rules generally cover flights departing the EU, plus flights arriving in the EU when operated by an EU airline. UK261 has a similar but separate scope for relevant UK journeys. The airline that operated the disrupted flight—not necessarily the website that sold the ticket—is normally the one responsible for the claim.
U.S. federal law does not generally require cash compensation for an ordinary flight delay. Airline customer-service commitments and refund rules may still help, so the country and route matter before you estimate a claim.
Measure the arrival delay
Under EU261 and UK261, arriving at the final destination at least three hours late can create a compensation claim. For a connecting itinerary on one reservation, use the arrival time at the ticketed final destination rather than the delay of the first segment alone.
- Save the original booking confirmation and boarding passes.
- Record the time the aircraft door opened at your final destination.
- Keep screenshots of delay notices and any written reason from the airline.
The cause can change the result
Airlines can avoid EU261 or UK261 cash compensation when they prove extraordinary circumstances caused the delay and reasonable measures could not have prevented it. Severe weather, security risks and some air-traffic-control decisions can qualify. Many routine technical faults and internal airline staffing issues may not.
The duty to provide meals, refreshments or overnight accommodation can still apply during a qualifying wait even when extraordinary circumstances prevent a cash award.
How to make a stronger claim
Ask the operating airline for the exact disruption reason, keep itemized receipts for reasonable expenses, and submit the claim through the airline’s official form first. If the response is unsatisfactory, the next step may be an approved dispute-resolution body or the relevant national enforcement authority.
